Welcome to Zapmail, a product of Outbox Labs Inc., headquartered in Delaware, USA. By Creating an account, purchasing a subscription, or otherwise using Zapmail's services, you ("User", "you", "your") agree to these Terms & Conditions ("Terms").
Zapmail provides automated cold email infrastructure and mailbox management powered by Google Workspace and Microsoft 365. By using our platform, you acknowledge that you understand the nature of our services and agree to comply with these Terms in full.
- Description of Services
Zapmail offers subscription-based infrastructure services, including but not limited to:
- Google Workspace & Microsoft 365 Setup – Mailbox creation, configuration, and DNS authentication (SPF, DKIM, DMARC).
- Domain Management – Domain registration, DNS setup, renewal handling, and redirection.
- SMTP Mailboxes – Setup and management of SMTP-based accounts.
- Pre-Warmed Mailboxes & Aged Domains – Provisioning of mailboxes and domains optimized for higher deliverability.
- Zap Shield – Real-time monitoring for blacklists, DNS reputation, and domain health.
- Third-Party Integrations – Direct integrations with outreach tools like Instantly, Smartlead, Reachinbox, etc.
⚠️ Important Disclaimer: Zapmail is not an independent email provider . It functions as an automation and provisioning layer on top of Google Workspace and Microsoft 365 . All accounts remain subject to the respective providers’ policies.
Zapmail cannot control or reverse actions taken by Google or Microsoft (e.g., account suspension, policy enforcement, or domain bans).
- User Obligations
- 3.1 Account Setup
You must provide accurate and complete information during registration. You are responsible for the confidentiality of your credentials and all activity under your account.
- 3.2 Legal Compliance
You agree to comply with applicable laws including CAN-SPAM, GDPR, and anti-spam regulations . You must ensure all recipient data and campaign content are compliant and ethical.
- 3.3 Prohibited Activities
You may not use Zapmail for:
- Phishing, scams, or fraudulent activities.
- Send unsolicited bulk emails (spam) .
- Violating Google or Microsoft's terms of service.
- Hosting or transmitting malware, ransomware, or harmful content.
- Using false headers or deceptive subjects to mislead recipients.
- 3.4 Enforcement & Suspension
Zapmail reserves the sole and absolute discretion to suspend or terminate accounts, domains, or mailboxes without prior notice if any misuse, abuse, or suspicious activity is detected.
Suspensions caused by upstream providers (Google, Microsoft, registrars, DNS hosts, or blacklists) are not the responsibility of Zapmail.
Suspended accounts are not eligible for reinstatement or refunds.
- Pricing, Payments & Renewals
- 4.1 Billing
All payments are non-refundable, billed in advance, and automatically renewed unless canceled via dashboard before the renewal date.
- 4.2 Renewal Adjustments Google and Microsoft provide first-year promotional pricing. After the initial 12-month period, pricing is automatically adjusted to standard renewal rates based on the provider’s updated structure.
- Renewal Pricing (Post-Year 1):
- Starter Plan: $59/month + $6/mailbox
- Growth Plan: $169/month + $5.5/mailbox
- Pro Plan: $499/month + $5/mailbox
- 4.3 Cancellation
Cancellations take effect at the end of the current billing cycle.
Early cancellations do not qualify for partial or prorated refunds.
- 4.4 Discretion
All decisions regarding refunds, credits, or exceptions are at Zapmail’s sole discretion.
- Specialized Service Conditions
- 5.1 Pre-Warmed Mailboxes
- Pre-warmed mailboxes are active for 12 months only and cannot be renewed or extended beyond their lifecycle.
- After expiration, a new purchase is required.
- Performance depends on user behavior (sending limits, copy quality, reply rate).
- Deliverability improvements are indicative, not guaranteed.
- 5.2 Pre-Warmed Domains
- Pre-warmed domains are bound to Zapmail-managed DNS for monitoring and cannot be transferred out of Zapmail.
- Transfer or manual modification attempts may lead to suspension.
- 5.3 Placement Tests
- Placement tests simulate deliverability in a controlled environment.
- Results do not represent guaranteed inbox performance; they are indicative samples dependent on user copy, frequency, and reputation.
- 5.4 Zap Shield
- Zap Shield improves domain and IP health visibility but does not ensure 100% blacklist immunity.
- Results depend on user practices, content quality, and compliance adherence.
- Zapmail is not liable for external blacklisting events or third-party delisting failures.
- 5.5 Partner Marketplace Perks (Partner-Controlled; New Purchases Only)
- Zapmail may feature partner perks, rewards, discounts, or coupon-based offers (“Partner Perks”) made available through third-party partners and their platforms.Partner Perks are applicable only to new purchases made directly on the partner’s platform and are not retroactive or applicable to purchases, renewals, upgrades, or transactions processed on Zapmail, unless explicitly stated otherwise.
- Partners have sole discretion and control over Partner Perks, including (without limitation) coupon eligibility, issuance, redemption, modifications, limitations, and cancellations. Zapmail does not guarantee the availability, acceptance, or continued validity of any Partner Perk and is not responsible for partner decisions relating to these coupons or offers.
- Intellectual Property
Zapmail retains all ownership rights in its software, systems, and branding.
Users are granted a limited, non-transferable license to use the platform for internal business purposes only.
- Termination
- 7.1 By Zapmail
Zapmail may terminate any account immediately if:
- Payment is overdue.
- Terms are violated.
- Misuse, spam, or abuse is detected.
No refunds or credits will be issued in such cases. - 7.2 By User
Users may terminate their subscription via dashboard. Termination takes effect at the end of the billing cycle.
Upon termination, all associated mailboxes, domains, and DNS configurations will be deleted permanently after 15 days.
- Data Protection & Privacy
Zapmail collects and processes user data as per its Privacy Policy.
Zapmail complies with GDPR, CCPA, and other applicable regulations.
Users are responsible for the lawful handling of their recipient data and consent management.
- Security
Zapmail employs advanced security protocols, including:
- Encrypted communications and data storage.
- Access control and monitoring systems.
- Internal audits and compliance checks.
Zapmail, however, cannot guarantee absolute protection against cyberattacks or provider-side security incidents.- Limitation of Liability
Zapmail is not liable for:
- Suspension of accounts or domains by Google, Microsoft, registrars, or blacklist providers.
- Loss of business, profits, or data.
- Deliverability performance variations due to external factors.
- Any indirect, incidental, or consequential damages.
Maximum liability is limited to the amount paid for the service in the last 30 days.
- Refund Policy
All purchases are final and non-refundable, except in cases of:
- Duplicate billing due to system error
- Service not provisioned within 7 business days of confirmed payment.
All refund decisions remain at Zapmail’s sole discretion.
- Data Breach Notification
In the event of a confirmed data breach, Zapmail will:
- Notify affected users within legally mandated timelines.
- Take all reasonable measures to contain and mitigate the impact.
- Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Delaware, USA.
All disputes shall be resolved exclusively in the Delaware state or federal courts.
- Modifications
Zapmail may modify these Terms at any time. Continued use after updates constitutes acceptance of the revised Terms.
